Legality - Conclusion (Or is it?!)

I just receieved a reply:

Good afternoon Mr Brian. My name is JH, I am PA to the owner of B***** Bar who has asked me to respond to your complaint. IT, the B***** Bar Manager, is on holiday and does not get back to work until this evening.

We are sorry to hear you were unhappy with the newly installed Clubscan equipment being used at the club, we can tell you that the other nightclubs in town are also applying to have the equipment installed and it comes recommended by Southend Police and is fully endorsed by the ICO, ((nformation Commissioner’s Office) and is in use in many of the London venues.

I have investigated your complaint personally and can confirm to you that your details were deleted by IT that evening as you did not enter the building. There is no record of you having asked to see the Manager at the time of your visit, he would have deleted your information whilst you were present and explained the process to you. The equipment is password controlled and can only be accessed with a USP dongle, which is held by Ian Thomas and no other member of staff has access to the data.

At present we do not use Clubscan as a data mailing system merely a door entry/security safety system in our continuing efforts to keep troublemakers out of the premises as the Southend Police’s “Behave or Be Banned” records are stored and allow the system to highlight people banned by the Police so that in accordance with the agreement we have with the Police, they are refused entry.

I hope this answers your concerns and should you decide to revisit B***** Bar please make your presence known to the Manager if you wish to talk to him further.

Yours sincerely JH

What you reckon I should do?

You should at least explain to them that you were not informed of what it was or how it would be used until after your ID was scanned, and therefore you demand some sort of compensation.

Shouldn’t they put up a sign informing visitors of the *new* policy and explaining why it is necessary? I am not sure what the law specifies, but it might be an idea for you to ask a lawyer (or a friend in lawschool for that matter) to look up the rules and regulations concerning this matter.

    Might be interesting to know.

    Still feel violated?

  4. Matt Says:

Yeah, definitely, I dont know what to do about it. I’m thinking of getting some free legal advice but I dont know whether its worth the hassle.

  5. Sam Says:

How did you ever get on with this one?

  6. Matt Says:

I have left it, I haven’t had the time to go back to it and complain.

    They won……..this time.
